With regard to the penalty towards criminals, there has long been heated debate over fixed punishment, with various arguments supporting and challenging it alike.
Fixed punishment adopted in most legal cases currently has an overwhelming advantage in effectiveness and justice. Above all, a given set of rules are obviously easier to implement and contribute to a more efficient process. Compared to a flexible approach to punish the criminals, it can also evert a deterring effect on the public by giving them strong impressions of specific kind of penalty according to different crimes thus to bring down the crime rate. To put it in a broader sense, stationary penalty with its clearness and openness, also serves as a significant presentation of social justice and equality, conducing to raising credibility to the government.
However, those who are opposed to fixed punishment may point out its defects and argue that despite its efficiency and seemingly perfect equality, a simple principle can’t cover changeable situations.
