    Concerning the penalty towards criminals, there has long been debate over whether the punishment should be held fixed or flexible.I think a flexible pattern of punishment is more beneficial compared with a fixed one.

    As a widely used approach of penalty, fixed punishment has many advantages. The main reason for its popularity lies in its efficiency and equality. Compared with a flexible approach to punish the criminals, a given set of rules is more convenient to implement and can avoid many unnecessary confusions in different cases. Besides, a fixed system of punishment also functions as a presentation of social justice and equality. Therefore, it can evert a deterring impact on the public, which can contribute a lot to bringing down the crime rate.

    However, those who are opposed to fixed punishment may point out its defects and argue that a simple principle can’t cover complicated situations. Therefore, to make up for the fixed penalty, some detailed factors are worth considering. When deciding upon the particular means of punishment, individual circumstances, the motivation of the criminal, and the background of the case are all indispensable information. For instance, a person killing in self-defense shouldn’t receive the same punishment as a purposeful murder.

    From my perspective, fixed punishment is undoubtedly necessary to guarantee the efficient process of the penalty system. However, when dealing with diverse cases, flexible consideration in terms of some details is important as well. In this way, the flexibility can enhance justice and equality on the foundation of the fixed penalty.
